Fast Fashion Showdown: Temu vs. Shein in Legal Battle over Alleged Unfair Practices
Temu, a Chinese e-commerce retailer, has initiated legal proceedings against its rival Shein, leveling serious accusations of “mafia-style intimidation” and other offenses. Filed as a 100-page complaint in a federal court in Washington D.C., the lawsuit alleges that Shein has been employing questionable copyright infringement notices against Temu and engaging in coercive tactics with suppliers to hinder Temu’s growth in the U.S.
The crux of Temu’s complaint revolves around Shein’s alleged summoning of suppliers believed to be associated with Temu to its offices. Once there, Shein purportedly detains these suppliers for extended periods, seizes their phones, and issues threats of penalties for conducting business with Temu. According to Temu, these actions represent a “desperate plan” orchestrated by Shein to eliminate a competitive threat in the U.S.
One of the more concerning aspects of Temu’s allegations is Shein’s purported coercion of thousands of suppliers to relinquish their intellectual property rights. These agreements are then allegedly used by Shein to secure copyright registrations in the U.S. Temu further contends that Shein is actively supporting dubious copyright infringement lawsuits against it and leveraging exclusivity agreements to restrict Temu’s access to suppliers.
Temu entered the U.S. market last year, gaining popularity through its offering of affordable goods, ranging from apparel to home products, shipped directly from China. Shein, originally founded in China and now based in Singapore, is renowned for its budget-friendly clothing items, primarily manufactured in China.
Notably, this legal clash is not the first between the two e-commerce giants. While both parties had previously filed lawsuits against each other in U.S. courts, they mutually withdrew their legal actions in late October for undisclosed reasons.
This recent lawsuit adds a new layer to the complex legal history between Temu and Shein, painting a picture of intense competition fraught with accusations of intimidation, coercion, and copyright-related maneuvers. The legal proceedings are expected to unfold in the coming months, shedding light on the veracity of these claims and potentially influencing the competitive landscape in the e-commerce arena.
